警察执行职务中的不作为犯罪的危害是非常严重的。不作为是指行为人负有实施法律要求的某种行为的积极义务,并且能够实行而不实行的行为。不作为的成立必须具备三个条件:行为人负有某种特定义务,行为人能够履行而没有履行这种义务,造成刑法所保护的社会主义社会关系的损害。警察不作为成立犯罪同样要符合上述条件。
The damage of negative crime of police in fulfilling duty is very serious. Negative act refers that actor has active duty demanded by law and can do it,but he did not carry it. Negative act must be of three requirements： actor has certain specially appointed duty; actor can fulfill but did not do it; cause damage to socialism relation protected by criminal law. Police＇s negative crime must be of above requirements as the same.
