试论非法人团体的法律地位

The legal status of the unincorporated society

就民事主体问题,传统民法坚持民事主体二元化理论,即以自然人和法人为民事主体,而不赋予非法人团体以民事主体地位。笔者认为,传统理论有其缺憾,科学的做法是应赋予非法人团体以独立的民事主体地位。文章从民事主体的发展历史、世界各国对待非法人团体的态度,以及我国的立法现状三个方面来论证。

Referring to civil subjects ,traditional civil law back up dualism. In other words, only natural person and legal person are treated as civil subjects, while unincorporated society is not presented with this status. In tile author＇s oplnion, there are some faults in traditional theory, and unincorporated society should have the legal status .This article will comment on this issue in three ways：the history of civil subjects, the attitude towards unincorporated society in other countries and areas, and corrent legislative situation in China
