摘要
原因自由行为是外国刑法中的一个重要理论。分析原因自由行为的概念特征和不得减免刑罚的理论依据,并结合中国刑法的实际,提出具体的立法建议,有利于中国刑法的原因自由行为理论的深入研究。
Action libera in causa is one of the important theories in foreign Criminal Law. Analyse the definition and characters of actio libera in causa and the theory basis of decrasing or exempting punishment as well. Combining the practice of Chinese Criminal Law, the author offers the concrete legislation suggestion, which is beneficial to the deep study of it.
