台湾地区与大陆地区法定夫妻财产制比较研究

A Comparative Study on Legal Spouse Property System Between Taiwan and the Mainland of China

法定夫妻财产制,是夫妻未以契约订立夫妻财产制时,直接予以适用的夫妻财产制度。在现实生活中,由于婚姻当事人通过订立契约来约定适用于自己的财产制度的为数甚少,绝大多数夫妻在婚姻关系存续期间总是依照法定财产制来处理财产关系,因而在夫妻财产制中,法定财产制具有特别重要的地位,它往往体现了一个社会对夫妻财产关系最基本的政策倾向和法律原则。我国台湾地区和大陆地区的法定夫妻财产制既一脉相承,又有着很大的差异,有必要对其进行比较研究。

Legal matrimonial regime has, when the couple have not concluded the matrimonial regime with the agreement ,given suitable property systems of couple directly. In real life, very few agree through agreement to deal with their property. It is very important to legal property. It often reflects a society＇ s basic policy and legal principle to legal property. The legal matrimonial regimes of Taiwan and mainland of our country have a great deal in common and also exist very great difference, so it is necessary to make a comparative study upon it.
