通过比较研究主要国家关于无因管理的实体法制度和法律适用规则,将我国未来《涉外民事关系法律适用法》关于无因管理的法律适用规则设计为:无因管理,适用管理行为实施地法。如果当事人之间曾存在其他法律关系,而无因管理起因于该法律关系,则适用调整该法律关系的法律。

Through comparative analysis and thorough study on the substantive and conflict rules for negotiorum gestio in major countries, this article designs a set of choice of law rules for negotiorum gestio that should appear in the coming “Law of Application of Laws in Civil Matters Involving Foreign Elements”, which reads as follows., negotiorum gestio should be governed by the place where the act of negotiorum gestio is carried out. Where negotiorum gestio arises from a legal relationship which exists between the parties, the law governing such relationship shall apply.
