摘要
不动产的特定性、固定性和所有不动产物权变动均需经过登记的法技术决定了其具有适用登记公示方式的基础和内在的实质合理性。动产的不特定性、流动性和一般动产物权以占有为公示方式的法技术决定了登记公示适用于动产具有难以克服的缺陷和严重的不合理性。《担保法》规定的动产抵押权因登记取得的对抗效力也严重不合理。建议我国未来立法或者废弃动产抵押制度,或者改全面的动产抵押制度为特别种类动产上的动产抵押制度。
Real estate's specific, immovable character and the legal technique that the property right alteration in real estate must pass through the registration determine that it has the foundation and inherent essential rationality to apply the form of registration for publication. Chattel is unspecific, movable and it has formidable defect and serious irrationality that the real rights in the general chattel apply the form of possession for publication. “Guarantee Law” is seriously unreasonable for the provision that the chattel mortgage rights acquire adverse effectiveness by registration. This article proposes discarding the system of chattel mortgage or changing the overall chattel mortgage system into another on the chattel of the special kind in the future legislation.
