世界死刑立法的趋势及我国的现实选择

The tendency of death penalty in the world and the right choice of China

死刑是剥夺犯罪分子生命的最严厉的刑罚。世界各国死刑的存废现状十分复杂。死刑的存废是由一个社会的经济、政治、人文等因素共同决定的。目前,西方资本主义国家具备死刑废除的条件,因为他们有发达的社会生产力、高度的政治民主和深入人心的人道主义价值观念,我国现阶段不具备废除死刑经济基础、政治条件和人文背景。

Death penalty is the most serious punishment to the offender. Due to the complex existence and abolishment of death penalty, the existence and abolishment of death penalty are jointly decided by such factors as economy, politics, humane background etc. Currently, the western capitalist countries have the conditions to abolish death penalty because they have developed productivity, advanced political democracy and deep-rooted humanism while our country has not the proper economic basis, political condition and humane background to abolish death penalty.
