中国传统法文化研究的优势与限度

Advantage and Limitation of the Study of Traditional Legal Culture in China

法学研究如果阙如法律文化的透析,法律文化的研究如果不以“传统”为传承,那么,中国法学似无源之水、无灵之躯。中国传统法律文化的研究近二十年来取得了很大的成就,其研究速度甚至超过国外的相关研究,同时也暴露出其存在的问题,主要表现是总体研究上缺乏系统化,层次研究上一元化,“现代化范式”下的西方中心化。本文欲对当下中国传统法文化研究予以宏观评析,以反思的方式凸显中国传统法文化研究中的悖论。

Jurisprudence of China would be like water without a source, or a body without soul if there is not perspective of legal culture and the study of traditional legal culture. The study about the legal traditional culture of China has achieved great success and its speed of studies even go beyond interrelated one from abroad. In the meantime, there are many problems, for example, lacks of general systematizing, unification in administrative levels and centralization of western world under modern paradigm. This article would comment on it in general on the base of criticize and thinking.
