摘要
离婚诉讼中的临时措施制度是根据离婚诉讼的特殊性设置的临时性强制措施。本文建议在我国未来修改离婚法时增设专节加以规定,其种类可设为禁令和临时执行令,其中禁令具体包括人身禁令和财产禁令,临时执行令具体包括人身执行令和财产执行令,同时设置严格的启动和执行程序。
The interim injunctions in the divorce proceeding is particular provisions to serve the particularity of the divorce cases. This paper＇s fiction is that we should enlarge injunctions and writs,personal and property injunction, personal and property writ. Then we should provide strict suggestion and execution proceedings.
