Regulatiing of the Relationship Between Law and Power and Its Socializing Development

如何处理法律与权力、法律与社会的关系,是改革和制度建设过程中不能不面对的问题。特别是,以往历史过程中形成的法律与权力的一体化传统及其产生的严重后果,使我们必须对这一问题有新的思考和定位。虽然国家权力是法律产生、形成及发挥作用的必要因素和条件,但在法治国家,法律又必须反过来成为制约、规范和控制国家权力的重要力量。对权力的法律约束,是当前制度建设的关键。在权力与法律的关系问题上,我们必须抛弃那种视法律为国家权力工具的习惯性思维,按照法治原则整合法律与权力的关系,理顺法律与社会的关系,促进法律的社会化发展。

How to handle the relationship between law and power and the relationship between law and society,is the inevitable problems confronted in the process of reformation and system construction.In particular,with its serious consequence,the tradition of unification of law and power,which was formed in the historical progression,forces one to reconsider and relocate this problem.Though national power is the necessary factor and condition of law's birth,formation and function,law must become an important force of restricting,regulating and controlling national power in a state governed by law.To restrain power by law is the key of current system construction in China.With regard to the relationship between power and law,we must throw away the habitual thought that law is regarded as the tool of national power,but to integrate law and power and clarify the relationship between law and society,thus promoting legal socializing development in terms of the principle of rule of law.
