摘要
企业所有权问题应当是法学予以详细研究的问题,但传统的民法所有权理论却并不能用来解释、解决这一问题。借鉴制度经济学关于企业所有权问题的理论,以比较为基础从法学上对企业所有权进行初步的界定,该权利是所有人对企业享有的最终控制权和收益权。
The issue of ownership of the finn should be studied in detail from the perspective of law. Nevertheless, the traditional ownership theory of the Civil Law can neither interpret nor solve this issue. This ownership enables the owner of the finn to enjoy the right of final control of the fn＇m and the right of benefit.
