村民选举中两委关系的法律思考

Legal Study on the Relationships of the two Committees in Election of Villagers

村民民主选举制度是保证村民实现民主的基本步骤。在村民选举过程中,应当明确村党支部和村委会在村民选举中的法律地位,理顺和协调两者之间的法律关系。文章主要从选举过程和日常工作的两个阶段,分析了在实践中存在的两委关系无法理顺的现象及其存在的问题,对两委关系不程序的根源探究并提出了解决问题的思路。

The democratic electoral system of villagers is the basic approach to ensure the villagers to realize democracy. In the process of the election of villagers, the legal status of the party branches of villages and the villagers＇ committees should be nailed down in the election of villagers, smooth and harmonize the legal relationships of the both. The article analyzes the phenomena that can not harmonize the relationships of the two committees that exists in practice and the existent problems mainly from the two stages of the election process and daily work, research into the origin of the disharmony of the relationships of the two committees, and put forward the train of thoughts to solve the problem.
