2004年10月1日生效的比利时《国际私法法典》,以1987年的《瑞士联邦国际私法》为蓝本,在本国的零星立法、判例和学说的基础上,吸收了大量的欧盟立法和国际条约,形成了一部内容相当完善的法典。对最密切联系原则的充分利用,当事人意思自治扩大适用,对外国判决和公证文书的完全承认原则,对和某些新近的民事制度的规定(如同居、同性结婚等),构成了其主要特色。
Having taken effect as of October 1, 21304, the new Belgian Code of Private International Law, has followed the example of the 1987 Swiss Federal Act of Private International Law and drawn rules from various pieces of domestic legislation, case law, and doctrine. It also incorporates a significant amount of the European Union legislation and norms set out in various international conventions, making it a complete codification of Private International Law. Its key characteristics include the full use of the most significant relationship principle, the greater room given to parties' autonomy, the recognition of foreign rulings without requiring exequatur, and the provisions made for new civil institutions, such as legal cohabitation and same sex marriage.
