完善国家赔偿制度的几点思考

Reflections on the Perfection of the State Compensation System

《国家赔偿法》从颁布到如今已有十个年头,它为加速我国法制化进程做出了积极的贡献,但在施行的过程中也发现了许多滞后于实际的缺陷,为此,应从如下几方面进行完善:改变国家赔偿的归责原则,拓宽赔偿范围,改进赔偿程序,提高赔偿标准,改变赔偿费用的支付方法,以利社会的和谐发展。

It is ten years since the State Compensation Law was promulgated. Although it has made great contributions to China＇s law development, it was found to have lagged behind practice in the implementation. Hence suggestions are made as follows： changing the principle of the state＇s compensation responsibility, widening compensation range, improving the compensation procedure, raising compensation standard and changing the method of payment so as to develop our society harmoniously.
