关于我国法官员额制度构建的实证考察

The Authentic Research into the Construction of Judicial System for Specified Number of Personnel

法官是社会正义的守门人。而我国的法官,人数多、地位低、待遇薄、素质差,因而,司法改革最根本、最迫切的任务之一应是法官员额制度的改革。文章对中外法官员额进行比较,指出我国法官员额制度存在的不足及原因,并通过调查,进行实证分析,对我国法官员额的确定及相应的改革措施提出了建议。

Judges are thought to be safeguards of justice in community. There are, however, many judges in china with poor qualities, low racial status and shabby treatment. Therefore, the reformation of judicial system for specified number of personnel is supposed to be one of the most urgent and fundamental tasks in judicial reform. Compared with overseas judges as specified number of personnel, this paper indicates the drawbacks of Chinese judicial system and their causes. Meanwhile, through investigation and authentic analysis, it also presents some suggestions on the definition of judges as specified number of personnel and its corresponding solutions.
