摘要
现实生活中,有时会出现夫妻一方擅自处分共有房屋的情形。此时,如果第三人是善意的,他能否取得该房屋的所有权。这涉及到不动产善意取得制度、家事代理权以及居住权和交易安全的冲突问题。笔者试从这三个角度出发,参照世界各国的立法例和我国现行的法律规定,对此进行论述。
