医疗机构改革的法律问题研究

Study of Some Law Issues Existing in Reform of Medical Institutions.

建立适应形势要求的卫生服务体系和医疗保障体系,是实现和谐社会的重要组成部分。医疗机构的改革是建立这一体系的唯一出路。《医疗机构管理条例》的修订是医疗机构改革的法律依据和保障。医疗机构改革必须坚持以下原则,适应社会主义市场经济形势,确保公民就医就诊的宪法权利,确立医疗机构的一般市场主体地位,国家通过宏观调控手段监管其运行,通过财政资金、社会保险基金、社会捐赠基金确保公民就医就诊的宪法权利得以实现。

The reform of medical institution is important to the goal of well-off society. Before begaining of the reform, we ought to have clear cognition：medical institution must fit to commulism market economy, our citizen＇s constitution right should be ensured. Medical institution should have independent main body state in the market. Government supervise medical institution with a indirect way. Government pay for citizen＇s medical fee in financial funds,social insurace funds and donation funds etc.
