On house demolition and public interests

房屋拆迁是以国家权力为后盾对私人房屋所有权进行干涉的行为。世界各国对房屋拆迁都规定了严格的限制条件,其中的目的性条件为"社会公共利益",只有符合公共利益,拆迁行为才合法。由于我国的《城市房屋拆迁管理条例》对拆迁的目的性条件规定不明确,在现实中,经常出现政府滥用拆迁权,侵害被拆迁人的合法权利的现象。因此,我们应确立社会公共利益作为我国城市房屋拆迁行为的目的性条件。

House demolition is a kind of act which is backed by administrative power and intervenes private house property. Many countries regulate the strict restrictive conditions about house demolition. Public interest is the most important in all the conditions and only for the purpose of public interests the house demolition is legal. In China, the purpose condition is not regulated definitely, so sometimes governments abuse the administrative power and trespass the household＇s rights. So we should make public interests as the purpose condition of house demolition.
