刑讯逼供是当前我国司法实务中的一大顽症,刑讯逼供案件的举证很困难,这直接造成了对刑讯逼供的打击不力。借鉴 英美法系的证明责任分层理论,对刑讯逼供案件的证明责任分担进行再改造,是遏止刑讯逼供的一条思路。

Using torture to coerce a statement is a persistent ailment in judicial practice in China. The evidence obtaining for cases of using torture to coerce a statement is very difficult, which results in the ineffective crackdown of such kind of cases. Learning from the hierarchic theory of burden of proof in Anglo-American law system, we can reform the burden of proof in using torture to coerce a statement and find a way to inhibit using torture to coerce a statement.
