摘要 玛瑞瓦禁令源于英国,是国际海事诉讼中的一项重要保全制度。作为英国民事诉讼中禁令的一种,玛瑞瓦禁令的目的是禁止被告在诉讼前或诉讼中转移或处分其财产,以此保障原告在将来胜诉时,有真正的财产来满足对胜诉判决或裁定的执行。玛瑞瓦禁令对海事诉讼,尤其是扣押船舶制度产生了重要的影响。通过具体案例对玛瑞瓦禁令的形成和发展作了详细的论述,以期对完善我国海事诉讼中的保全制度有所借鉴。 Mareva Injunction as an important preservation system in international maritime cause was come from England. The purpose of the Mareva Injunction is forbid the accused to transfer or dispose of his property before action or in action and guarantee plaintiff have real property been carried out. Mareva Injunction has important influence on maritime cause, Specially on attaching ship system. The paper through concrete case detailedly discussed the formation and development about Mareva Injunction, for perfecting the preservation system of our country in maritime cause.
