A Brief Discussion about the Right of WTO Panel to Seek Information——An Analysis of Article 13 of DSU

WTO协定的规则体系不是自足的产物。为了弥补WTO协定运作过程中可能出现的缺漏,促进争端的积极解决,DSU第13条赋予专家组一种自由裁量权———信息获取权。这种权利虽然在目前颇有争议,但它毕竟拓展了WTO的发展空间。

The system of the WTO rules is not self-sufficient. Article 13 of DSU provides the WTO panel with discretion, which is the fight to seek information. By using it, the panel can remedy the defects of WTO practicing and promote the settlement of disputes. Though it is uncertain now, this fight has made a new way of developing WTO practicing.
