法律、法规赋予海事管理机构在水上交通事故调查处理中“查明原因、判明责任”的职能,“责任”含义的多样性导致对“判明责任”含义的不同理解。从“责任”的基本含义阐述“判明责任”的内容及“判明责任”与“法律责任”的关系。
Maritime Safety Administration(MSA) performs the duty of ascertaining the cause & fixing the fault in the course of marine accident investigation defined by law & regulation.Misunderstanding of the relative words such as 'responsibility' & 'fault' and so on leads to misunderstanding of fixing the fault.The article discusses the very meaning of 'fixing the fault' confining 'duty' to its basic meaning and discerns the relationship between fixing the fault and legal liability.
