On the Legal Thoughts on the Operation of Disciplinary Authority and Its Limitation

近年来不断涌现的学校被诉案件,反映了学校处分权与学生受教育权的现实冲突正在加深,也暴露了学校处分权行使中的非法治化、非适度性。对此,必须加强对学校处分权行使的约束与限制,构建合理的法律制约机制,以达到合理与合法的最佳契合。

Current cases in the disciplinary actions of colleges are new problems calling for attention. It is urgent contradiction between the disciplinary authority of college and the right to education ,it is not rule of law and irrational. Therefore ,the disciplinary authority of college should be subject ,legitimate systems of legal restriction should be established to make sure the full achievement of the legality and the rationality.
