Reconstructing Operating System of Villagers' Right of Autonomy

村民自治制度是农村基层民主的主要内容,村民自治权的运行状况将直接影响到中国基层民主的实现路径和程度。在实践中,村民自治存在着自治机关权责不均衡、监督不力等弊端,这已构成农村基层民主实现的障碍。国家公权运行的规律表明,权力的合理分工和配置是其正当运行的基石。具有特殊性质的村民自治权亦应遵循此类规律,更加科学的村民自治权运行框架应当建立在国家公权运行规律这一基础之上。

Villagers＇ right of autonomy is a main part of the rural democracy in grass-roots units. Its operation directly influences the realization route and degree of the democracy in grass-roots units of China. Unbalanced responsibility of power and right and weak supervising are the drawbacks of organs of self-government, which has been the obstacle to rural democracy in grass-roots units. The article, starting from national public right＇s operating rule, analyzes the property of villagers＇ right of autonomy, connection with the operation of national public right, and puts forward the preliminary suggestion of reconstructing villagers＇ right of autonomy.
