辩证地看待患者的知情同意权

Looking at Patient's Rights of Being Informed and Consent Dialectically

知情同意权是患者的一种法定权利,包括知情权与同意权。根据马克思“没有无义务的权利,也没有无权利的义务”的思想,患者的这一权利既伴随着医方的义务,也伴随着患者自身一定的义务,因而该权利的真正实现需要医患双方辩证地理解权利与义务的关系,并积极地履行各自的相关义务,当然主要依赖于医方义务的积极履行。

The rights of being informed and consent is a legal right of the patients which include the right of being informed and that of consent. According to the thought of Marx-there is no right without duty and there is no duty without right, it is clear that this kind of the patients＇ right is accompanied with the duty of the hospital and that of patients themselves. Thus the real realization of this right needs the hospital and patients understanding the relationship between right and duty and their positive fulfilling their own duties. Of course it mainly depends on the hospital.
