摘要
基于劳动法律关系主体现实的不平等性,劳动法越来越多地表现出“私法公法化”的趋势。我国《劳动法》不仅要符合私法原理,而且从某种意义上说还带有行政法的色彩,呼唤更多的公权力的介入。我国劳动合同制度中,关于劳动合同关系建立的规定并不能保证劳动合同的要式主义,对于劳动合同解除的规定也略显宽泛,所以应在完善劳动立法的基础上,加强行政执法,以保障劳动关系的稳定性和当事人的合法权益。
Because of the inequality of subjects of labor-law relations,labor law gradually demonstrates the trend of “private laws publicize”,Labor Law in China must be not only in accordance with the principle of private law,but,to some extent,administrative law,asking for the involvement of public powers.In labor contract system in China,the regulations about the removal of contract seem to be loose.Therefore,on the basis of improving legislation,the execution must be strengthened,in order to guarantee the stability of labor relations and legal rights of parties involved.
