The Humanity Challenges the Capital Punishment

对罪犯的人道是指对罪犯的宽容与同情。死刑之所以不人道,是因为它剥夺生命,使人因同情、怜悯被判死刑的人而产生不快与不忍。在公正、效益和人道三大刑罚价值中,人道是废除死刑的惟一理由,而公正是保留死刑的惟一理由。死刑存废的矛盾体现在公正与人道的矛盾上。

The humanity to the criminal is the tolerance and humanitarian because its killing someone lets people displeasure sympathy to the criminal. The capital punishment is not and insufferable. Among even, efficiency and humanity, humanity is the only course of abolition of the capital punishment, even is the only course of maintain of the capital punishment. But even and humanity both are the feelings in the heart, it is difficult for us to know which is more intensive in the heart of the people. If feeling of even is more intensive, the capital punishment must be maintained, if feeling of humanity is more intensive, the capital punishment must be abolished.
