防卫过当是一种特殊的犯罪形态,其犯罪构成要件与其他普通犯罪的构成要件有很大不同。防卫过当的特殊性主要体现在犯罪主体具有防卫人和侵害人的双重身份,主观罪过形式只能是间接故意或疏忽大意的过失,侵害的客体是“侵害人”的生命、健康权,客观方面的行为是复合行为(合法行为与违法行为的结合),犯罪对象具有特殊性。

Unjustifiable self-defense is a special form of criminal offence. There＇s great difference between constitution of crime elements of unjustifiable defense and other popular criminal constitution elements. The author in this paper regards that its particularity mainly embodied in that criminal subject possessed double citizenship of defender and infringer, the form of subjective crime can only be indirect and intentional negligence or careless and inadvertent negligence. Encroaching objective is an act of encroaching the life, the healthy right. The objective aspect is the combination of lawful action and unlawful action. And the criminal object has particularity.
