本文从仲裁第三人的性质与特点、设立仲裁第三人的理由与必要、世界各国仲裁立法的最新发展、我国仲裁实践对仲裁第三人的制度探索等方面,论证了设立仲裁第三人制度的合理性、必要性和可行性,主张通过修改《仲裁法》设立仲裁第三人制度,冲破设立仲裁第三人制度的禁区。

The paper, from three aspects of the nature and features of the third person of arbitration, reasons and necessity of setting the third person of arbitration and its new trend in the world, and the practice of arbitration in our country, discusses the rationalization, necessity and feasibility of setting up third person arbitration system so as to break out the forbidden zone.
