由一起非婚生子女抚养案谈我国民事诉讼中的亲子鉴定制度

On Child Determination System in China's Civil Action from a Case of Non-Marriage-Born Child

由于亲子鉴定关系当事人的人身权利和财产权利,关系到家庭结构的稳定和整个社会的安定,因此,应该建立是一个较为完备,相互配套的亲子鉴定制度体系。在对亲子鉴定机构和质量的管理中,应建立一个规范化、标准化的体系和制度;发挥法院的自由裁量权;允许法院可依职权进行委托鉴定;在一定条件下可进行亲子关系的推定。

Because child determination concerns personal right and property right of persons concerned, concerns family stability and social stability,a comparatively perfect child determination system should be established. In child determination organ and quality management ,a standard system should be set up to bring court＇s free ruling right into play and allow court to do child determination according to its own right.
