The Contribution of Bilateral Investment Treaties to the Development of International Investment Law: A Chinese Perspective

双边投资条约已代替模糊的国际习惯法形式而成为当今国际投资法的最主要的法律形式,从中国视角对国际投资法由形式至内容的这场变革作出确切评估是非常必要的。双边投资条约是两大阵营在国际投资体制陷入僵局之后,各发达国家与发展中国家不约而同所选择的打破僵局的灵活方式,这一新的法律形式对国际投资保护法及国际投资自由化法律的发展各有不同。双边投资条约至今仍是以特别法形式存在的双边条约,从中并未产生确定的国际习惯法。

The bilateral investment treaties（BITs） have become the main sources of international investment law in place of the arguable customary international law, and it is necessary to comment on the fundamental changes from the form to the content from a Chinese perspective. The BITs are a flexible manner to repair the old system that the developing countries and the developed countries both favored when both parties have reached an impasse in the international investment system. The BITs have different influence on investment protection and investment liberalization. The BITs are special law in nature, from which a specific international customary law hasn＇t arisen yet.
