Principles of Legal Exchange and Legal Translation

随着国际环境的变化,中国对外法律交流日益发展。法律交流的重要环节之一是法律翻译,法律交流有一系列原则,其中与语言相关的原则对法律翻译实践有直接的借鉴作用。法律翻译合适性是译者追求的目标,是译者为达到诸多因素最佳和谐而进行自始至终的选择的结果,法律交流原则和法律翻译合适性目标的结合能使译者从宏观和微观两个方面把握翻译过程。本文从法律交流三个原则、法律翻译的合适性目标以及这二者的结合论述法律翻译的选择过程,并且利用简单的例子进行论证。

With the favorable change of the international situation, legal exchange between China and foreign countries is gaining speed. Legal exchange comprises a series of components, one of which is legal translation that is of great importance. There are a number of basic principles of legal exchange, among which the linguistic ones have direct implications for legal translation. Besides, appropr/ateness is one of the objectives always pursued bytranslators. The combination of legal exchange principles and the appropriateness of legal translation can enable translators to manage the translation process from both macro and micro points of view. The present paper discusses and illustrates translation as a process of selection by focusing on the afore-mentioned principles, appropriateness, and their combination.
