论依法行政中的德性

On the moral character of the law-based administration

立足于行政法治的角度对依法行政与以德行政的关系进行初步探讨,认为以德行政是依法行政的基础,依法行政是以德行政的必然结果;以德行政包含于依法行政之中,依法行政是对以德行政的逻辑推演等。为此, 法性不得代替德性,传统依法行政理论中由于割裂了二者的关系,以致依法行政的实用价值大打折扣。德性可以单独进行分析,但若将它置于依法行政之外探讨就无太大的现实意义。

While making an elementary investigation into the relationship between the law -based administration and the morality - based administration from the angle of administrative legality, we hold that the morality - based administration is the basis of the law - based administration, and that the law - based administration is the inevitable outcome of the morality - based administration. Thus, the legal character can not replace the moral character. The traditional law -based administration theory has cut apart the relationship between the two, so that the practical value of the law - based administration has greatly fallen short of requirement. The moral character can be analyzed alone, but it＇ s of little practical significance for it to be probed outside of the law - based administration.
