商业秘密保护中的价值冲突与权利冲突研究

The Conflicts of Values and Rights on the Legal Protection of Trade Secrets

在商业秘密法律保护中存在着一系列的价值冲突与权利冲突。法律对任何权利的保护都应是有限度的,否则将容易造成权利人对权利的滥用。因此,法律对商业秘密的保护应有一定的限制。在对商业秘密保护中的价值冲突、权利冲突进行分析的基础上,借助法经济学和法理学的分析方法探讨冲突的解决问题。在坚持追求价值最大化的前提下,尊重社会主导价值观和社会总体利益,贯彻共同抑制标准和效率优先、兼顾公平原则来寻找权利保护的临界点和平衡点,从而解决冲突。

There are a series of the conflicts of values and rights during the course of the legal protection of trade secrets. The legal protection of any kind of rights should be limited, or the subject of the right may abuse it. So the legal protection of trade secrets should be limited,too. The problem is, however, how to balance between one kind value and another, one kind of right and another. Maybe the legal economical theory can be of some help to solve the problem.
