摘要司法调解是民事审判的重要结案方式,调解语言作为法庭话语的一个重要组成部分却很少有人研究。本文以真实的调解话语为语料,以会话结构理论为分析框架,对司法调解中出现频率很高的冲突性打断进行研究,从打断的类型和语用功能、打断的互动特点与打断人的权力关系以及打断对调解结果的影响等方面进行了分析,认为打断是调解中重要的话语策略,调解参与人如能顺应语境因素,适时进行打断,将有助于调解朝自己所倾向的结果发展。 Judicial mediation is an important way to wind up a case in civil lawsuits. Based on the transcription of authentic mediation discourse and classic theory of conversational analysis, this paper analyzes the conflicting interruption in terms of its categories, pragmatic functions, and interaction features with regard to the intermpter＇s power, and points out that interruption is an important conversational strategy. If used properly, this strategy will help the mediation participants to achieve their expected goal.
