我国民族自治州的立法困境及对策

The Legislation Troubles and Countermeasures in the Minority Prefectures——Take Xiangxi Prefecture for Ebcample

当前,我国建构民族自治州立法机制中面临的困境:立法权源与层级的不对等造就立法的无序、上级机关审批程序的失范、部门利益、地方利益抬头,造就民族自治州立法实践中的种种非法治化倾向。扶持民族自治州优化地方立法机制要划定权限、明确职责、强化监督、同时也要尊重国情地情,有序地推进。

Presently, the legislation troubles in the minority prefectures are seen in the following aspects： legislation disorder caused by unequal legislation sources and levels;disorder examination from the upper level;department and local profit; and the improper legal practice. To support the legislation system in the minority prefectures, it＇s necessary to clarify duty and reinforce supervision, and take the local and national conditions into consideration.
