国际电力贸易的WTO法律规范分析

WTO Law on International Trade in Electricity

随着互联技术的快速发展以及更多国家致力于市场自由化,国际电力贸易将变得愈来愈重要,因而有必要明确建立一个国际法律框架。WTO不否认电是一种商品,同时也充分尊重了其特殊性。为了促进全球的电力贸易,应号召WTO的成员国在最惠国待遇、非歧视以及互惠互利磋商的基础上在未来作出相应的承诺。

As greater technical possibilities for interconnection are realized, and as more countries embark on market liberalization, international trade in electricity will become more and more important. It is imperative that the international legal framework for trade in electricity be clearly established. WTO doesn＇t deny the fact that electricity is a good, and recognizes its particularity. In order to foster the global trade in electricity, the members of the WTO should be called upon to make related commitments in the future on the basis of the most-favored-nation treatment, non-discrimination and negotiation of mutually advantageous benefits.
