On Penal Litigation Conventional Procedure Simplify Trail ——Comment the relationship with justice and efficiency

1996年刑事诉讼法修改在普通程序之外增设了简易程序。从近几年的司法实践来看,简易程序对提高诉讼效率确实起到了积极作用,收到了一定效果,但目前适用简易审程序的比率还相当低。引进外国的“辩诉交易”制度,既有利于简易审程序的适用与完善,也有利于正确把握简易审与公正效率的辩证关系。
