当今社会自由心证已经成为一项世界性的刑事诉讼制度,但在我国它至今仍被认为是主观唯心主义而拒绝。实际上这是一种基于对马克思主义辨证唯物主义哲学形而上学理解而产生的偏见。自由心证证据制度较好地解决了证明主体的主观能动性与证明过程的法律限制的矛盾,它既遵循了人类认识的一般规律,赋予法官在判断和运用证据的理性思维活动中的充分主观自由;又适应了现代法治的基本要求,把刑事证明过程纳入规范、文明的程序之中。消除成见,以真正辨证唯物主义的科学态度来研究和借鉴自由心证是加速我国刑事证据制度科学化的必须。

Free evaluation current has already become a world criminal suit system, but it is still considered to be subjective idealism and is not accepted until today in China. This is prejudice in fact that produced against understanding the dialectical materialism philosophy of Marxism in metaphysics way. The evidence system of free evaluation has solved the contradiction well between the subjective initiative of proving the subject and the law limiting to proving the course. It not only follows universal law of the mankind knowing, and entrusting the abundant subjective free to a judge in the rational thinking activity of judging and using evidence, but also adapts to the modem society＇s basic demand for rule by law, which the course of criminal suit proving is brought into the procedures of the norm , civilization. If accelerating the scientific process of the system of criminal evidence of our country, we must study and consult free evaluation with the scientific attitude of real dialectical materialism without prejudice.
