男性生育权问题探讨

An Inquiry Into Males' Procreation Right

生育是一个久远而常新的话题 ,然而基于男女两性的生理差别 ,以及近现代女权运动的发展 ,人们对生育权的讨论和关注大多集中在妇女的生育权上 ,对男性生育权问题研究得很少 ,甚至予以否认。但从我国法律及国际法精神看 ,男性生育权存在具有合理性和合法性 ,其生育行为能力受生理、伦理等因素的限制。在特殊情况 (婚内、单身、被监禁 )下 ,仍应保障男性生育权的实现。

Procreation has always been an eternal but updating topic. However, since the physiological difference between two sexes and promotion Of modern feminism, attention to procreation right are focused on females, scarcely on males, and someone even deny their rights. However, looking from our laws and the spirits of law of nations, the male＇s procreation right has reasonable basis and lawful reasons. The males＇ proceation ability is limited by physiological and ethical reasons and so on. In the special instances, we should protect the realization of males＇ procreation rights.
