摘要
合法有效的劳动合同是用人单位与劳动者之间维护各自权益 ,实现“双赢”目的的有效途径。市场经济条件下 ,劳动者可以按照市场规则自由流动。为避免商业秘密在人员流动过程中被泄露 ,用人单位应当通过订立违约金、保护商业秘密、竞业禁止等条款维护自身的合法权益。
Legal and effective labor contract is the useful way that the employment unit and the laborer protect each right, get the aim of double- win. In the market economy, the laborer can flow freely with the market rules. In case that commercial secrets are let out in the course of person's flowing, the employment unit should protect the legal rights with sign the clauses of damages, defending commercial secrets, forbidding the competition.
