消防队员怠于救助困于大火中的小孩致使小孩丧生。对于消防大队和消防队员是否应该承担责任有两种不同的观点 ,一种观点认为消防队员的行为违反刑法中关于紧急避险的规定 ,另一种观点认为应该从行政不作为的角度客观评价消防大队和消防队员的行为。正确予以认定的前提是准确界定不作为与紧急避险的异同。

The fireman slighted saving the children in the fire which made the children lost life. There are two different points about fire department and fireman. One point is that the actions of fireman disobey the prescripts about urgent avoiding risks in the Criminal Law.
