On the Petfection of Testament Execution's System

遗嘱执行制度是遗嘱继承中的一项重要制度 ,对于保障各方关系人利益和稳定社会秩序具有重要的意义。《继承法》对遗嘱执行只是略有提及而无实质规定。借鉴外国民事立法 ,结合我国司法实践 ,遗嘱执行制度应在遗嘱执行人的产生方式、遗嘱执行人资格、遗嘱执行人的职责作等方面进行修正和完善。

The system of testament execution is an important one in testament inheriting, It has important meaning to ensure the benefits of the partakers. Meanwhile,it could make social orders stable. There is only a little recite on testament execution in Inherit Law, but has not essential prescript about it. Consulting foreign civil legislation and combining native judicial practice, the system of testament execution should be amended and perfected on the aspects, which are the fashion of executor＇s production, the qualification of the executors and the responsibilitie of the executors.
