试论罪刑相当原则在腐败案件中的运用

On the Application of PPTC in Corruption Case

罪刑相当原则是司法实践中的一项重要原则,其意义在于使罪、责、刑三者相适应,以达到处罚和教育的双重目的。本文通过考察目前腐败案件判决中存在的处罚过轻现象,提出在腐败案件中正确运用罪刑相当原则,以期积极发挥其双重功效。

Proportionate Punishment to Crimes （PPTC） is an important principle in the justice, which means to balance the crime and punishment to reach the aim of punishment and education. In this paper, the author analyzes the less severe punishment in the corruption case nowadays, them brings out the suggestions of using PPTC principle appropriately in such cases to play positive role in punishment and education.
