摘要
本文旨在从话语分析角度为'法官如何提高驾驭庭审技能'探寻一个可行的操作办法.首先,文章运用功能语法关于语言元功能的理论模型分析了诉讼双方对案件事实的叙述在概念功能、人际意义、语篇功能上的对立焦点,然后指出对抗的实质是意义的不确定性和言语信息对抗所构成的意识形态之争.最后,探讨了对立叙事的话语语言对于法官主持庭审的启示.
This paper aims to propose a feasible solution, from the perspective of discourse analysis, to the issue of how to improve trial skills of judges, as a complement to others. It first analyses the contests of the two opposing statements on facts-construction in terms of ideational, interpersonal and textual functions under the framework of Hallidayan metafunctioas of language. Then, it goes on to expose the indexical natures of these conflicts, namely, the contestation between different interpretations to the same fact, and the competition for the honor to be deemed as legitimate. At last, it discusses the implications of this analysis to judges.
