试论中国废除死刑的条件

A discussion on Conditions to abolish the death-sentence

赞成废除死刑的绝大多数法学者都认为中国目前的法制还不健全,尚不具备废除死刑的条件,为废除死刑做准备的重点是改革刑法。本文作者认为除此之外我们也不能忽视从哲学的角度作探讨。

After some time of arguments, they＇ve reached a common conclusion： the day of the abolishment of the death-sentence will come sooner or later, that is to say, death-sentence is to be abolished undoubtedly. Besides, the majority of those legal scholars who agree on the abolishment of death-sentence all have the same idea that the current legal system is still not perfect yet, and it＇s not the right time to take the step to abolish death-sentence at present, however, the key point to abolish death-sentence is to revise and strengthen the Criminal Law. I myself think, besides that, we can also talk about it from the philosophic aspect, What should we do on other sides of Chinese society in response to the abolishment of death-sentence？
