《民法通则》第120条确认了精神损害可以要求经济赔偿。这为人民法院审判精神损害赔偿案件提供了法律依据,且为广大公民保护自身合法权益拓展了新的空间。2001年最高法院通过的《最高人民法院关于确定民事侵权精神损害赔偿责任若干问题的解释》进一步确认了我国精神损害赔偿制度,并在许多方面作了比较完善的规定。本文以此为基点,对精神损害赔偿的概念、性质和功能、范围、原则作了系统阐述。

The rule 120th of “The general principles of civil law” affirms the claim of spiritual damages, it offers legal basis for the spiritual damages case, and better protects the citizen＇s rights. In 2001, the supreme people＇s Court passed “The Supreme People＇s Court＇s Interpretations on the Spiritual Damages to the Civil Invading authority” confirmed the system of spiritual damages in our country at a further step, moreover there were many consummate stipulations in many respects. The article gives a systematic explanation on the spiritual damages, its concept, character, function and limit.
