简易、小额诉讼程序制度探讨

A Tentative Discussion about Proceeding Procedure of Minor Offences

为适应当前社会发展的需要,解决司法服务供需不平衡的矛盾,我国有必要专门设立简易、小额诉讼程序制度。目前我国现行简易诉讼程序中存在无完善体系、界限不清、配套不全等诸多问题。要完善我国现行简易诉讼程序,必须从推行“繁简分流”的举措、简化诉讼程序等方面着手。

In order to meet the requirements of social development, and to solve the contradictions of imbalanced supply of and demand for legal service, it is necessary to set up the judicial proceedings system for minor offences with petty amount. Currently there are some issues concerning our legal proceedings for minor offences, such as imperfect system, unclear demarcations, incomplete procedures. Therefore, to perfect our current simple legal proceedings, some measures should be taken to promote the split-flow of the complicated and the simple, and to simplify legal proceedings.
