对《中华人民共和国反倾销条例》程序性规定的认识

倾销作为一种不公平竞争的行为,为世界各国一致谴责,反倾销是世界贸易组织和各国允许使用的抵制进口产品不公平竞争的合法合理的方法,是世贸组织允许的世界各国均可采用的维护公平贸易秩序、抵制不正当竞争的重要手段之一。当前,打击倾销,控制其不发生或者少发生,是各国政府管理进口贸易的重要任务与共同目标,也是学术界十分关注的研究课题。目前,我国已取代日本、韩国成为反倾销的重点对象,是国际上遭受反倾销投诉最多的国家。所以,应加强反倾销立法工作,扩大对反倾销的认识,提高企业的应变能力,面对不断增加的国外反倾销投诉,充分合理地利用世贸组织的具体制度和相关规则,形成一套完善的诉讼机制,不断丰富解决争议的手段和方法,从而维护自身的合法权益。

As an unfair competitive activites, the dumping has reproched by every countries all over the world with one voice, to antidumping is the legitimate method which allowed to use to fitht against importing productions by unfair competition using by WTO and any other countries, and it is also one of important instrument allowed by WTO which is to maintain fair trade order and fight against unfair competition could use by any other countries. Currently, to fight against dumping, and to restrain them from disappearing or as less as they appearing, is the important mission and collective aim by govemment of every countries managing import trade, and it is research problem which is pay attention by academic circle quitely. At present, China has been replaced Japan and Korea to be a primary antidumping country, and also a country facing to the most of acusations all over the world. This article proposes that we need to enhance strength of anfidumping legislation, extend the understanding of antidumping activities, and improve responding ability of corporations. When we facing to increasing antidumping acusafions by other countries, we must use specific system and related rules and regulations of WTO very adequately and reasonably, to structure a perfect lawcuit system, and abundance instruments and methods by resolving dispute endlessly, accordingly, to protect legal rights by oneself.
