我国湿地保护的立法思考

湿地是一种特殊而复杂的生态系统,对人类具有重要的生态价值。由于人口和经济的增长,其生态功能的脆弱性在现行法律框架下更为突出。我国现行立法对于湿地资源的开发、利用、保护和管理显得严重滞后,本文通过分析湿地对人类具有的生态、经济价值,反思现行法律、法规对湿地资源保护之缺陷和不足,旨在为我国建立和完善湿地保护专门法律提供有益的探索和建议。

Wetland is a kind of special and complicated ecosystem, exerting mankind a significant ecological value. Due to the development of population and economy, the problem of its ecological weakness becomes strikingly urgent under present law system. The present legislation of wetland in our country lags behind the wetland＇s development, exoloitation, protection, and administration. In order to offer useful exoloration and suggestions in establishing and improving the specifie law for protecting wetland, the wetland＇s ecological and economic values for mankind are analyzed in the aricle and deficiency in wetland protection is reflected on present law system and regulations.
